Placing the order, paying for and\/or using the \u201cMAPIT\u201d package consisting of the Application (which is licensed to you and requires a subscription) and the Device; or<\/p>\n 2. Downloading and activating the Application.<\/span><\/p>\n Contracting the \u201cMAPIT\u201d package means that you accept the General Terms and Conditions of Contract, so we ask that you read them carefully before proceeding to accept them. If you do not accept them, i) we will not supply the Device to you; ii) we will not grant you the license for the Application; and iii) you will not be able to use or have access to the Subscription.<\/p>\n You understand that, by accepting these General Terms and Conditions of Contract, you are legally bound by them.<\/p>\n Please note that if you have only downloaded the Application and do not have an active Subscription or the Device installed on your vehicle, you will not enjoy all the functionalities of MAPIT.<\/p>\n <\/em><\/p>\n 1.1 – The General Terms and Conditions of Contract constitute a contract between you and the relevant MAPIT group entity (Spain: MAPIT IoT, S.L., C\/ Casp 172, 4B 08013 Barcelona and NIF B-66716291 \/ Portugal: MAPIT PORTUGAL, UNIPESSOAL LDA, Rua das Merc\u00eas, n.\u00ba 41, Cowork 9000-224 FUNCHAL and NIF: 519130286) [\u201cMAPIT\u201d] for the grant of a license to use the MAPIT computer application (the \u201cApplication\u201d), whose functionalities are made available to you through a subscription (the \u201cSubscription\u201d). The contracting entity that applies to you will be the one identified in your contract or contracting confirmation, regardless of the language in which you read these General Terms and Conditions of Contract.<\/p>\n 1.2 \u2013 The functionalities of the Application can only be used through the interaction of the Application with the separate telematics device (the \u201cDevice\u201d), which shall be installed by the vehicle manufacturer or the workshop, and which shall be connected to such vehicle. The Application and the Device shall together be referred to as the \u201cMAPIT Package\u201d.<\/p>\n 1.3 \u2013 By contracting the MAPIT Package, we grant you a limited, personal and non-transferable license to use the Application under the General Terms and Conditions of Contract and in accordance with the rules or policies applied by Apple (App Store), Google (Google Play) or any other platform that may become operative in the future (\u201cApp Store\u201d) from which the Application has been downloaded (\u201cApp Store Rules\u201d).<\/p>\n When placing an order for MAPIT, you declare that you are of legal age and have the legal capacity to contract. To this end, MAPIT reserves the option to request from you, at any time, documentation proving your age. If MAPIT verifies that you do not have the required age, or you do not comply with MAPIT\u2019s request, or you do so incorrectly, MAPIT may cancel the Subscription and the license.<\/p>\n 1.4 \u2013 Compatibility Requirements: the Application requires a mobile phone device running an operating system no lower than iOS 16.4 or Android 10. Starting from version 10.28.0 of the Application, a device with a 64-bit processor is also required.<\/p>\n Devices that do not meet these requirements will not be able to download or install the versions of the Application that require them. If the user already has a compatible earlier version installed, whether the user can continue to use it will depend on its technical compatibility with the service, without prejudice to MAPIT\u2019s legal obligations regarding conformity and necessary updates, including security updates.<\/p>\n Where an update or a change in requirements may prevent or limit access to the contracted service, MAPIT will inform the user in advance and by the means required by law, indicating the available alternatives and the rights that apply to the user, including, where applicable, termination of the contract and the corresponding refund.<\/p>\n 1.5 \u2013 To contract the MAPIT Package, you must follow each of the steps of the procedure provided on the MAPIT corporate website and\/or, where applicable, in the Application. You undertake to place legally valid orders.<\/p>\n If you detect an error in the contracting process, you must contact MAPIT immediately, through atencioncliente@mapit.me<\/a>, to report and correct the error as soon as possible.<\/p>\n 1.6 – You will be assumed to be the owner or to have permission for use by the owner of the cell phone or mobile devices that you use, but which are owned by third parties (\u201cThird Party Device(s)\u201d) before downloading a copy of the Application to such devices. Both you and the owner may incur data charges from third parties (such as the Internet provider or carrier) in connection with the use of the Application through your mobile device or a Third Party Device. You shall be solely responsible for all such charges. If you do not wish to incur such charges, please refrain from using your mobile device or Third Party Device to access the Application or to activate the Subscription.<\/p>\n 1.7 \u2013 Third party websites are not under our control and we are not responsible for their content or policies. Thus, it is up to you to make your own choices regarding your interaction with any third party website, including the purchase and use of any products or services accessible through them.<\/p>\n 1.8 \u2013 The customer service channels are as follows:<\/p>\n Spain: atencioncliente@mapit.me<\/a><\/p>\n Portugal: atencioncliente@mapit.me<\/a><\/p>\n MAPIT may change the contact details by simple notice to the user or by updating the information published in the Application or on the corporate website.<\/p>\n 2.1 \u2013 MAPIT may modify these General Terms and Conditions of Contract for legal, regulatory, technical, operational, security or commercial reasons, or to incorporate new functionalities, products or services.<\/p>\n Modifications will be notified to the user by any reasonable means that allows effective knowledge of them, including, among others, notifications within the Application, e-mail, push messages, SMS, publication on the corporate website or any other channel enabled by MAPIT. Unless MAPIT expressly indicates otherwise, continued use of MAPIT after that date will constitute acceptance of the modified General Terms and Conditions of Contract.<\/p>\n Where the modifications substantially affect the rights and obligations of the parties or essential elements of the contractual relationship, MAPIT may require express acceptance of the new General Terms and Conditions in order to continue using certain services or functionalities.<\/p>\n In all other cases, the modifications will enter into force on the date indicated in the corresponding notice.<\/p>\n <\/p>\n 3.1 \u2013 The Application is owned by MAPIT IoT, S.L., the parent company of the MAPIT group.<\/p>\n 3.2 \u2013 You acknowledge that all intellectual and industrial property rights relating to the Application and\/or the Device, any documents provided in respect of them, the technology used or supporting them or any of their functionalities, belong to MAPIT and\/or, where applicable, its licensors; you further acknowledge that the rights to the Application have been licensed to you and that you have no rights in the Application, the documents or the technology therein, other than the right to use each of its elements in accordance with the General Terms and Conditions of Contract.<\/p>\n 4.1 \u2013 The Device and the Application work together to provide the Application functionalities. In order to enjoy these functionalities and activate your MAPIT Package, you will need to:<\/p>\n 4.1.1 \u2013 Download the Application to the Device from the relevant App Store.<\/p>\n 4.1.2 \u2013 Read in full and expressly accept the General Terms and Conditions of Contract and place an order for the MAPIT Package.<\/p>\n 4.1.3 \u2013 Pay the price of the MAPIT Package.<\/p>\n 4.1.4. \u2013 Register the Device and connect it to your vehicle.<\/p>\n 4.2. \u2013 To access and utilize all MAPIT functionalities, you must have a compatible Device installed in your vehicle and the Application on your mobile device or Third Party Device (as applicable) connected to your Device installed in your vehicle.<\/p>\n 4.3 \u2013 You may enjoy the use of the MAPIT Package until the first contractual anniversary (\u201cInitial Term\u201d), unless the Subscription is terminated early in accordance with the General Terms and Conditions of Contract or the Subscription is renewed in accordance with clause 4.6.<\/p>\n 4.4 \u2013 The Application includes connectivity, geolocation, vehicle monitoring, alerts, statistics, reports, vehicle maintenance and configuration functionalities, as well as any other functionalities accessible through the Application or linked to the MAPIT Device, which may evolve, be modified or be extended through future updates of the Service.<\/p>\n Among others, the Application includes the following features and functionalities:<\/p>\n (i) Create a profile: you will be able to customize your experience of the Application and gather in one place the key data of your motorcycle, such as model, year of manufacture, engine and VIN, etc.;<\/p>\n (ii) Find your motorcycle: you will be able to locate your motorcycle thanks to GPS;<\/p>\n (iii) Share your location: you will be able to share the location of your motorcycle;<\/p>\n (iv) Trip analysis and statistics: you will be able to access data regarding your trips, GPS location, mileage, average speed, maximum speed, duration, periodic statistics and other information related to the use of the vehicle;<\/p>\n (v) Alerts and notifications: you will be able to receive automatic alerts and notifications related to vehicle movements, tilt or fall detection, incidents, ignition status, exit from delimited zones and other events detected by the Device;<\/p>\n (vi) Maintenance history and reminders: allows you to record maintenance and inspections of the motorcycle, as well as to receive automatic reminders associated with the periodic maintenance of the vehicle;<\/p>\n (vii) Reports and export of information: you will be able to generate and download reports or summaries related to the activity, trips and use of the vehicle;<\/p>\n (viii) Custom configuration: you will be able to configure certain operating preferences of the Application, notifications, temporary alert suspension modes and visual elements associated with the vehicle.<\/p>\n (ix) Temporary suspension or hibernation functionalities: you will be able to activate temporary suspension, hibernation or equivalent modes of the Device in order to reduce communications, activity or battery consumption associated with the Service.<\/p>\n 4.5 \u2013 MAPIT may offer, in certain modalities, promotional campaigns or specific functionalities, free trial periods of the Application or the Service. Where applicable, the specific conditions applicable to the trial period, including its duration, scope, limitations and activation requirements, will be communicated to the user during the corresponding contracting or activation process. Activation of certain trial periods may require prior registration of a valid payment method. Once the free trial period has ended, the Subscription may be renewed automatically in accordance with the conditions communicated to the user at the time of contracting, unless the user has previously cancelled the Subscription before the end of the promotional period.<\/p>\n 4.6 \u2013 After the Initial Term, your Subscription will automatically renew for additional terms of one (1) year (\u201cAdditional Term\u201d), unless you cancel it in accordance with the provisions of the General Terms and Conditions of Contract. Hereinafter, the Initial Term and, where applicable, the Additional Term shall be deemed together as the \u201cDetermined Duration\u201d.<\/p>\n 4.7 \u2013 Updates to the Application may be released periodically through the relevant App Store, provided that the Application corresponds to the description of the Application provided to you before you contracted the MAPIT Package. MAPIT may release updates, improvements, bug fixes or new functionalities periodically. Certain updates may be necessary to ensure the conformity, security and proper functioning of the Application and the associated digital services.<\/p>\n Certain updates may require acceptance of new contractual conditions, legal notices or specific policies where necessary for legal, regulatory, technical or functional reasons. In such cases, MAPIT may limit access to certain functionalities, in whole or in part, until the corresponding acceptance is given.<\/p>\n <\/span><\/p>\n 5.1 \u2013 All images of the Device are for illustrative purposes only. Your Device may vary slightly from such images.<\/p>\n 5.2 \u2013 The specific costs of delivery of the Device will be as indicated to you at your physical or online point of sale in the ordering process. Installation of the Device in the vehicle is not included, although some point of sale may offer you that service at their own risk.<\/p>\n 5.3. \u2013 Once it has been verified that the contracting has been carried out correctly, MAPIT will deliver the Device to the address you indicated in the contracting procedure, provided that it is in Spain or Portugal, or in such other countries as MAPIT may add from time to time, or to the dealer selected by the Customer, within a period that shall in no case exceed thirty (30) days following the date of order confirmation. The Application will be made available to you immediately after the General Terms and Conditions of Contract have been accepted and MAPIT has correctly received the payment.<\/p>\n Delivery of the Device to the Customer will be made directly or through a transport company. Delivery will be deemed to have been made from the moment the Device is made available to the Customer and, as regards the Application, from the moment it is accessible and\/or downloadable.<\/p>\n If the supply of the Device is delayed for reasons not attributable to MAPIT, we will contact you as soon as possible to inform you and, if possible, will take appropriate steps to minimize the effect of such delay. As long as we act in this manner, we will not be responsible for delays caused by such an event.<\/p>\n 5.4 \u2013 You will become the owner of the Device once we have received full payment for your MAPIT Package and you have registered in the Application.<\/p>\n 5.5 \u2013 We may update or make changes to the Device (such as, for example, microprogram updates or Device replacements) in order to:<\/p>\n 5.5.1 \u2013 Reflect changes in relevant legislative and regulatory requirements.<\/p>\n 5.5.2 \u2013 Implement minor technical improvements and adjustments, for example to prevent and\/or mitigate a security threat. These changes will not affect the use of MAPIT, which may incorporate updates to add enhancements and new functionalities.<\/p>\n All orders for Devices are subject to availability. If the Device is not available, you may cancel the contract and recover the amount paid as soon as possible.<\/p>\n <\/span><\/span><\/p>\n 6.1 \u2013 The price for the MAPIT Package will be the one indicated to you in Euros during the order process, and will include the use of the Application during the Initial Term. Value Added Tax (VAT) and\/or, where applicable, any other tax and\/or fee applicable in the territory of application, will be charged at the corresponding rate under applicable law.<\/p>\n 6.2 \u2013 The price for the use of the Application during the Additional Term for each of the additional one (1) year terms will be as we inform you prior to the time you access and accept your subscription. Given the periodic nature of the subscription to the Application, MAPIT will charge your payment on the first day of each of the additional one (1) year terms, by SEPA direct debit or to the bank card whose details you have entered or selected in the contracting process, as detailed in sections 6.5 and 6.6 below. The charge will be made once it is accepted by the financial institution through which the payment is made, since otherwise the contracting cannot be carried out.<\/p>\n 6.3 \u2013 MAPIT reserves the right to change at any time the prices for the use of the Application, although such modification shall not have retroactive effect. In any case, the price applicable to the order placed will be the one stated at the time of accepting the General Terms and Conditions of Contract. MAPIT shall not be obliged to supply the service at the incorrect lower price (even after the \u201cPurchase Confirmation\u201d) if the pricing error is obvious, evident or unequivocal or constitutes an error in the declaration of intent (error obstativo<\/em>) and could have been reasonably recognized by you.<\/p>\n 6.4 \u2013 Unless expressly stated otherwise in particular conditions or specific promotions, Subscription periods that have not been consumed in whole or in part will not give rise to any right to refund, compensation, accumulation, transfer or application to subsequent Subscription periods. Early cancellation of the Subscription or any change to the contracted plan will not entitle you to retain or transfer unused days.<\/p>\n The foregoing does not limit the rights of withdrawal, termination of the contract or refund to which the user is entitled under applicable regulations, including those provided for in clause 1.4.<\/p>\n 6.5 \u2013 You may use SEPA (Single Euro Payments Area) direct debit as a method of payment, in which case the amount of the payment will be debited from your bank account, in accordance with the terms of the mandate applicable at any given time. In this case, you authorize MAPIT to send instructions to your financial institution to debit the corresponding amounts on your behalf and, to the extent necessary, you must request your institution to make the debits to your current account in accordance with MAPIT\u2019s instructions.<\/p>\n 6.6 \u2013 MAPIT may also offer users the possibility to pay for the subscription of the Application by Visa or MasterCard or any other cards that MAPIT may provide for from time to time. You simply must enter the details of the card to be used in the \u201cPayment Information\u201d tab of the subscription process. Such data will not be stored by MAPIT, but by the payment service provider.<\/p>\n If you wish to receive an invoice for your Subscription, you must request it by e-mail at atencioncliente@mapit.me<\/a>. Invoices will be issued in electronic format, without prejudice to the user\u2019s right to request that they be issued in physical (paper) format where applicable.<\/p>\n 6.7 \u2013 Please note that you will be responsible for any charges from your carrier and network provider for your mobile device or Third Party Device, payment in addition to the amounts you pay for the use of MAPIT.<\/p>\n 6.8 Once the contracting process is complete, you will receive an e-mail confirming the contracting, together with a copy of the General Terms and Conditions of Contract.<\/p>\n 6.9 Once MAPIT has verified that the contracting has been carried out correctly, it will deliver the Device, within a period that shall in no case exceed thirty (30) days following the date of order confirmation. The Application will be made available to you immediately after the contracting procedure is completed.<\/p>\n <\/p>\n 7.1 \u2013 You agree:<\/p>\n 7.1.1 \u2013 Do not copy the Application, except when necessary for backup or operational security purposes.<\/p>\n 7.1.2 \u2013 Do not rent, lend, sub-license, lease, translate, combine, adapt, vary or modify the Application.<\/p>\n 7.1.3. \u2013 Do not make modifications or alterations to the whole or part of the Application nor allow it or any part of it to be combined with any other programs or be incorporated in these.<\/p>\n 7.1.4 \u2013 Do not disassemble, decompile, reverse engineer or create derivative works based on all or part of the Application.<\/p>\n 7.2 \u2013 You shall not:<\/p>\n 7.2.1 \u2013 Use the Application, or any of its functionalities, in an unlawful manner, for any unlawful purpose, or in any way that is inconsistent with these Terms and Conditions, or act in a fraudulent or malicious manner, for example, by unlawfully accessing the Application, the Device or other operating systems or by inserting malicious code, including viruses or harmful information.<\/p>\n 7.2.2 \u2013 Infringe intellectual property rights when using the Application or any of its functionalities.<\/p>\n 7.2.3 \u2013 Submit content that is defamatory, offensive or objectionable in connection with Your use of the Application or any of its features.<\/p>\n 7.2.4 \u2013 Use the Application or any of its features in a manner that could damage, disable, impair, overload or compromise our systems or our security or interfere with other users.<\/p>\n 7.2.5 \u2013 Collect or harvest information or data from the MAPIT Package or our systems or attempt to decrypt transmissions destined for or derived from the servers operating the MAPIT Package.<\/p>\n 8.1 \u2013 MAPIT uses all necessary efforts to ensure that the Device and the Application work properly, avoiding errors or repairing them where appropriate and keeping the contents of the Application duly updated. However, MAPIT cannot guarantee the availability and continuity of access to the Device and the Application, nor does it guarantee that their contents are free of errors or that they will always be kept up to date. You agree to the foregoing and undertake to exercise the utmost care and caution when accessing and making use of the Device and the Application or the contents, information and services made available.<\/p>\n Certain MAPIT functionalities depend on geolocation technologies, mobile connectivity, sensors, telecommunications networks and automated data processing, so certain alerts, notifications, statistics, reports or reminders may be affected by technical incidents, connectivity interruptions, environmental conditions or limitations of the device or vehicle itself.<\/p>\n 8.2 \u2013 MAPIT reserves the right to modify, extend, suspend, delete or update, subject to the information and notice duties that apply, including those in clause 1.4, the information, configuration, presentation or functionalities of the Application or the Service, for technical, operational, commercial, regulatory or security reasons.<\/p>\n 8.3 \u2013 You agree not to use the Device or the content available on the Application at any given time to infringe a regulation or to perform an action that may be considered unethical or contrary to good customs or to the image and professional reputation of MAPIT.<\/p>\n 8.4 \u2013 MAPIT shall not be liable for any consequences that may arise from the improper use of such content or from the negligence of users in relation to such content.<\/p>\n 8.5 \u2013 Users who access MAPIT\u2019s Device and Application and who use any information or services accessible through them do so exclusively on their own responsibility.<\/p>\n The alert, detection or notification functionalities offered by MAPIT are purely informational and intended to support the user, and do not constitute emergency services or certified safety systems, nor do they replace official technical inspections or maintenance of the vehicle.<\/p>\n 8.6 \u2013 MAPIT shall not be liable for any damage caused to the vehicle, software or hardware of the users resulting from the access or use of the Device or the Application, nor for the possible costs of installing or uninstalling the device for any cause whatsoever.<\/p>\n 8.7 \u2013 In addition to the foregoing, and to the extent permitted by law, under no circumstances shall MAPIT be liable for personal, incidental or special damages, whether caused directly or indirectly. This includes any damages due to loss of profits, loss of employment or failure to obtain employment, loss of data, business interruption or any other commercial damage or loss related to the use, or inability to use, MAPIT services, without limitation and regardless of the cause and theoretical liability (whether contractual, non-contractual or otherwise), even if the user has been advised of the possibility of such damages.<\/p>\n 8.8 \u2013 You are aware, and voluntarily agree, that you use the Device and the Application solely on your own responsibility, and you shall therefore be liable for any damages of any kind that MAPIT may suffer as a result of your failure to comply with any of your obligations under the General Terms and Conditions of Contract, the Privacy Policy or applicable law in connection with your use of MAPIT.<\/p>\n 8.9 – In any event, the warranty of the Devices will be in accordance with the regulations in force and, therefore, as a general rule, MAPIT will be liable for lack of conformity manifested by you within three (3) years from delivery of the Device or two (2) years in the case of the Application.<\/p>\n Products and services are deemed to be in conformity if they meet the objective and subjective requirements of conformity under the regulations in force, provided that, where applicable, they have been correctly installed or integrated.<\/p>\n If the product or service sold by MAPIT is not in conformity, you must inform MAPIT as soon as possible by sending an e-mail to atencioncliente@mapit.me<\/a>.<\/p>\n In the event of return of the Device due to lack of conformity, the costs of the return will be borne by MAPIT.<\/p>\n <\/span><\/p>\n \u00a09.1 \u2013 You have a period of fourteen (14) calendar days to exercise your right of withdrawal (\u201cCancellation Period\u201d), counting from the date of delivery of the MAPIT Device.<\/p>\n You expressly acknowledge and accept that activation of the Device and of the digital services implies the start of performance of the service. Consequently, once such performance has started, you will lose the right of withdrawal.<\/p>\n Withdrawal may be exercised through the mechanism or button provided by MAPIT for this purpose, as well as by notice to the address atencioncliente@mapit.me<\/a>.<\/p>\n In any case, in order to exercise the right of withdrawal, you must refrain from using the Application and from making it available to third parties. Consumers are also entitled to the corresponding refund in accordance with applicable regulations.<\/p>\n You may also cancel the subscription for the next service period whenever you wish, at which time you will lose access to all content on the Application and, consequently, to all content and services set out in clause 4.4 above.<\/p>\n By virtue of the foregoing, you agree that (i) if you have commenced use, or (ii) if the Cancellation Period has elapsed, you will have forfeited your right of withdrawal for the supply of the Application and will not be entitled to any refund.<\/p>\n 9.2 – Devices that have been handled in the way necessary to establish their nature, characteristics or functioning will be accepted for return. However, you will be liable for any reduction in the value of the Device caused by handling other than as indicated above. Thus, the Device may be tested, but it must be kept with sufficient care, in perfect condition for the use for which it is intended and without signs of wear or dirt, complete in all its parts and accompanied by all accessories and leaflets.<\/p>\n 9.3 – Once the right of withdrawal has been duly exercised and, in any case, within a maximum period of fourteen (14) calendar days from the date of receipt of the Device and the withdrawal request, MAPIT will refund the full amount of the contract, including, where applicable, shipping costs and in accordance with the payment method used by you.<\/p>\n 9.4 \u2013 In the event that a Device has been installed in your vehicle and you wish to cancel your Subscription before the end of the Determined Duration, you must disconnect the Device, otherwise certain of your personal data may continue to be received by MAPIT and third party companies, as indicated in the Privacy Policy, for as long as the Device remains connected to your vehicle. It is your responsibility to ensure that the Device is disconnected at the time you cancel your Subscription, regardless of the reason for cancellation.<\/p>\n You agree that the Device will not provide any functionality once your Subscription is terminated. After six (6) months following cancellation, in order to protect the privacy of users, the Device may be irreversibly permanently deactivated, all in accordance with the personal data protection regulations in force from time to time.<\/p>\n <\/span><\/span><\/span><\/p>\n 10.1 \u2013 In the event that MAPIT wishes to cancel the license prior to the expiration of the Determined Duration, MAPIT will notify you at least thirty (30) days in advance. In this event, MAPIT will reimburse you for any amounts you have paid in advance, if any, for the entire period between the date of interruption of the Subscription and the expiration of the Determined Duration during which you cannot take advantage of MAPIT.<\/p>\n 10.2 \u2013 In addition, MAPIT may cancel your MAPIT Package at any time, without refund or prior notice, in the event that:<\/p>\n 10.2.1 \u2013 At any time, you seriously or repeatedly breach the General Terms and Conditions of Contract.<\/p>\n 10.2.2 \u2013 You provide us with false information or conceal important information from us in connection with your use of MAPIT.<\/p>\n 10.2.3 \u2013 You breach our rights or the rights of third parties in the Application or the Device.<\/p>\n 10.2.4 \u2013 You attempt to commit fraud or act dishonestly with respect to our interests.<\/p>\n 10.3 \u2013 In the event that the Application causes your vehicle or Device to malfunction, or where there are reasons to believe that the Application presents a security threat to you, we may uninstall the Application and we will contact you to implement the corresponding corrective measure.<\/p>\n 10.4 \u2013 If we cancel your Subscription because you have seriously breached the General Terms and Conditions of Contract, we may permanently block your access to the Application and cease to provide you with access to MAPIT.<\/p>\n 10.5 \u2013 You will be responsible for communicating your request for cancellation of the MAPIT Package, as well as any other aspect that may have an impact on the service itself (such as, for example, the sale of your vehicle, an accident or theft of the vehicle). MAPIT will assume no refund in relation to those users who have not communicated an incident within forty-eight (48) hours of its occurrence.<\/p>\n 10.6 \u2013 In the event that you sell your vehicle, in order to protect the privacy of the new buyer, you must disconnect the Device from your vehicle before selling it.<\/p>\n 10.7 \u2013 In addition, you are responsible for disconnecting the Device at the end of the Subscription or in the event that you sell your vehicle.<\/p>\n <\/p>\n Below we set out how MAPIT processes your personal data, in its capacity as Data Controller.<\/p>\n 11.1.1 \u2013 When a Device is connected to your vehicle, MAPIT may collect the following categories of information:<\/p>\n a) Your VIN (Vehicle Identification Number), which identifies your vehicle (and which is associated with other information about you), its make, model and year of manufacture and purchase.<\/p>\n b) Mileage, tire pressure, oil levels, battery condition, date of last service, warnings, incidents and other electronically recorded aspects related to the use and operation of your vehicle.<\/p>\n c) Your bank details and other financial information that may be required when you activate or renew your Subscription.<\/p>\n d) Data of the mobile device to which the Subscription is linked through the Application.<\/p>\n e) GPS data to determine your location, the location of your vehicle and\/or your mobile device, in relation to the location of your vehicle, including the relevant locality and country in which each item is located<\/p>\n f) The speed of travel in your vehicle, including average speed, parking duration, incidents of hard braking, incidents of sudden acceleration and incidents of speeding above 130 km\/h.<\/p>\n g) An analysis of the route taken by your vehicle, including average speed, distance traveled, parking time, events (such as exceeding self-established speed limits).<\/p>\n h) In addition to the above, MAPIT may also collect the following information, additionally:<\/p>\n (i) \u2013 Your first name and surname and contact details, that is, your postal address, telephone numbers, e-mail address and your signature; and<\/p>\n (j) \u2013 Your user PIN (which may contain a reference or information that is of a personal nature).<\/p>\n (k) IP address of your connection.<\/p>\n 11.2.1. The information detailed above will be collected mainly from you, but we may also collect it from the dealers with whom we have a commercial relationship.<\/p>\n 11.3.1 \u2013 MAPIT may use your personal data for the following purposes:<\/p>\n a) Answer and\/or deal with a request or inquiry from you.<\/p>\n b) Improve the functionality and quality of MAPIT.<\/p>\n c) Manage MAPIT when you have an active Subscription, which may include (among other things):<\/p>\n (i) \u2013 Allow you to locate nearby dealers or workshops and contact them through the Application.<\/p>\n (ii) \u2013 Customize your Application experience and gather in one place the key data of your vehicle, such as model, year of manufacture, engine and VIN, etc.<\/p>\n (iii) \u2013 Book an appointment for service of your vehicle at the dealer or workshop of your choice.<\/p>\n (iv) \u2013 Notify you of the date of your next review.<\/p>\n (v) \u2013 Locate your vehicle thanks to GPS.<\/p>\n (vi) \u2013 Share the location of your vehicle.<\/p>\n (vii) \u2013 Access data relating to your trips and\/or your driving style, such as data on average vehicle speed, parking time, mileage, and GPS.<\/p>\n (viii) \u2013 Delimit the zone in which you allow your vehicle to be driven and receive an alert if the vehicle leaves this zone.<\/p>\n (ix) \u2013 Generate automatic alerts, statistics, reports, reminders and notifications associated with the condition, maintenance, location or activity of the motorcycle.<\/p>\n (x) \u2013 Send automatic communications to emergency contacts designated by the user in the event that alert or detection functionalities are activated.<\/p>\n (xi) \u2013 Manage automatic notice functionalities or emergency alerts that may involve communicating location data and other information associated with the vehicle or trip to the emergency contacts designated by the user.<\/p>\n d) To comply with legal obligations; and<\/p>\n e) Send you commercial communications about MAPIT that may be of interest to you.<\/p>\n 11.3.2 \u2013 Please note that as long as the Device is connected to your vehicle, we may continue to process some of your personal data for the purposes detailed above, even when your Subscription has expired. Therefore, if you no longer want MAPIT to process such personal data, you must have your dealer or workshop disconnect or deactivate your Device.<\/p>\n 11.3.3 \u2013 MAPIT may also convert personal data into anonymous data and use it (usually on an aggregated statistical basis) for research and analysis to improve MAPIT. For more information, please refer to the following section Aggregated information.<\/p>\n 11.4.1 \u2013 Aggregate personal information does not personally identify you or any other MAPIT user. It may be used for statistical analysis and administration, such as, for example, trend analysis, performing actuarial work, product customization, risk assessment and associated cost analysis in connection with MAPIT\u2019s operation.<\/p>\n 11.5.1. The legal basis for the processing of personal data is the performance of the contractual relationship and compliance with certain legal obligations.<\/p>\n 11.6.1 \u2013 MAPIT may disclose your personal data to logistics and transport companies for the delivery of your product, to dealers or manufacturers for internal administrative purposes, to dealers, workshops and emergency companies, in the cases where you so request and, where applicable, to the emergency contacts designated by you in the event of incidents with the vehicle. Likewise, we may disclose your data to financial institutions for the collection of the services provided through the Application, as well as to the Public Administration in the cases provided for by law.<\/p>\n 11.7.1 \u2013 Your personal data may be processed or accessed by our service providers who are not located within the European Economic Area (\u201cEEA\u201d). Consequently, individuals with a connected Device and\/or using MAPIT should be aware that such recipients may be located in countries or territories outside the EEA, under conditions of security and confidentiality, in accordance with the necessary legal safeguards, further information on which may be requested by e-mail to gdpr@mapit.me<\/a>.<\/p>\n 11.8.1 \u2013 MAPIT will take the necessary technical and organizational measures to protect personal data against any unauthorized access, alteration, transmission, public disclosure, erasure or destruction, as well as damage and accidental loss or deletion of personal data.<\/p>\n 11.9.1 \u2013 The data provided will be retained for as long as necessary to carry out the purposes referred to above and as long as you do not disconnect or deactivate the Device from your vehicle, and, thereafter, for the years necessary to comply with legal obligations (in particular, contractual, accounting and tax obligations).<\/p>\n 11.10.1 \u2013 You will have the right to request information about the processing of your personal data, to access them, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.<\/p>\n 11.10.2 \u2013 In certain circumstances, you may request the limitation of the processing of your data, in which case we will only keep them for the exercise or defense of claims.<\/p>\n 11.10.3 \u2013 For reasons related to your particular situation, you may object to the processing of your data.<\/p>\n 11.10.4 \u2013 Under the right to portability, you have the right to obtain the personal data concerning you in a structured, commonly used and machine-readable format and to transmit it to another controller.<\/p>\n 11.10.5 – Likewise, you have the right not to be subject to automated individual decisions.<\/p>\n 11.10.6 \u2013 The rights may be exercised by e-mail to our DPO gdpr@mapit.me<\/a>.<\/p>\n 11.10.7 \u2013 If you consider that the processing of your personal data infringes data protection regulations, you have the right to lodge a complaint with a supervisory authority, in particular the one in the Member State of your habitual residence, your place of work or the place of the alleged infringement, without prejudice to any other administrative remedies or judicial actions available to you.<\/p>\n In Spain, you may contact the Spanish Data Protection Agency (AEPD, www.aepd.es<\/a>) and, in Portugal, the Comiss\u00e3o Nacional de Prote\u00e7\u00e3o de Dados (CNPD, www.cnpd.pt<\/a>). It is not necessary to first lodge a complaint with MAPIT in order to exercise this right.<\/p>\n <\/p>\n 12.1 \u2013 We shall not be liable for any failure or delay in the performance of any of the obligations assumed under the General Terms and Conditions of Contract when caused by acts or events beyond our control, such as, for example:<\/p>\n 12.1.1 \u2013 Failure in public or private telecommunication networks.<\/p>\n 12.1.2 \u2013 Lack of GPS signal, Internet connection, or as a result of a serious collision that destroys all or part of the Device or any interconnected system (such as your phone) to the extent that it ceases to function, preventing the transmission or receipt of information to\/from the relevant impact alert operator.<\/p>\n 12.1.3 \u2013 Failure of the Application to provide the functionalities (including, in particular in providing you with an accurate trip analysis) due to lack of GPS signal, lack of Internet connection, adverse weather conditions or as a result of a serious collision that destroys all or part of the Device or any interconnected system (such as your phone) to the extent that it stops working, not allowing the transmission or reception of information, or the failure of telecommunications networks or other similar events (\u201cEvent Outside Our Control\u201d).<\/p>\n 12.2 \u2013 If an Event Outside Our Control occurs that affects the performance of our obligations under the General Terms and Conditions of Contract:<\/p>\n 12.2.1 \u2013 Our obligations under the General Terms and Conditions of Contract shall be suspended and the time for performance shall be extended for the duration of the Event Outside Our Control.<\/p>\n 12.2.2 \u2013 We will do everything possible to seek a solution that will enable the obligations under these Terms and Conditions to be fulfilled despite the Event Outside Our Control.<\/p>\n 13.1 \u2013 If you wish to contact MAPIT or make a complaint, you may contact us through the \u201cHelp\u201d section of our website hosted at the URL mapit.me<\/p>\n 13.2 \u2013 We will make every effort to answer your query as soon as possible and, in any case, before a period of one month has elapsed from the time it is submitted to us.<\/p>\n 13.3 \u2013 The user accepts that MAPIT may send communications related to the service, the Subscription, the Device, the Application, security matters, technical incidents, renewals, updates, contractual modifications, changes to the Privacy Policy and any other aspect linked to the contractual relationship by e-mail, notifications within the Application, push messages, SMS or other electronic means provided by the user or enabled by MAPIT.<\/p>\n <\/p>\n 14.1 \u2013 The General Terms and Conditions of Contract are drafted in Catalan, Spanish, English and Portuguese. In the event of a conflict between the versions, the Spanish version shall prevail.<\/p>\n We may assign our rights and obligations under the General Terms and Conditions of Contract to another entity without affecting your rights or our obligations under them. In this case, you will be duly notified of such assignment.<\/p>\n 14.2 \u2013 The General Terms and Conditions of Contract are agreed between you and MAPIT. You may only transfer any rights or obligations arising from the General Terms and Conditions of Contract with MAPIT\u2019s prior written acceptance.<\/p>\n 14.3 \u2013 If any of the clauses of the General Terms and Conditions of Contract is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, and the remainder will remain in force in all other respects, the provision or the affected part of it being deemed not to have been included. For these purposes, the General Terms and Conditions of Contract will cease to be valid solely with respect to the null or ineffective provision, no other part or provision thereof being annulled, invalidated, impaired or affected by such nullity or ineffectiveness.<\/p>\n 14.4 \u2013 If we do not claim or require you to perform any of your obligations under the General Terms and Conditions of Contract or if we do not enforce our rights or are late in enforcing them, this does not mean that we have waived our rights against you or imply that you do not have to comply with those obligations. If we do waive any default, we will do so only in writing, and it will not imply that we will automatically waive any subsequent default.<\/p>\n 14.5 \u2013 Where the contracting entity identified under clause 1.1 is MAPIT IoT, S.L., these General Terms and Conditions of Contract shall be governed by and interpreted in accordance with Spanish law.
